Analytical report: “MONITORING OF CHANGES IN THE CUSTOMS SECTOR RELATED TO THE IMPOSITION OF MARTIAL LAW IN UKRAINE” in 2022

Based on the results of a survey of representatives of foreign trade, customs brokers and experts specializing in reforming the bodies implementing customs policy in Ukraine. The Association of Customs Brokers of Ukraine has prepared an Analytical Report

The purpose of the survey was to identify the main changes in customs clearance procedures in connection with Russia’s full-scale military aggression against Ukraine.

Based on the results of the monitoring, which included 8 focus group discussions with business representatives during September – December 2022.

The overwhelming majority of respondents consider queues at the borders, export-import restrictions, difficulty in obtaining simplifications and delays in cargo clearance to be the main problems and obstacles related to customs clearance procedures in times of war.

  1. Queues at the borders, resulting from:

– Limited capacity of the MAPP due to physically and morally outdated infrastructure near the western border of Ukraine;

– Lack of investment during the war;

– Lack of agreement with European countries on joint customs control;

– Poor quality and speed of the phytosanitary service due to its incomplete digitalization.

  1. Restrictions on exports and imports due to

– Excessive control by the EU;

– Complicated transportation logistics;

– High cost of cargo transportation;

– Confirmation of customs value;

– Obtaining permits in case of need for additional types of control;

– Opposition of European customs officers, who encourage carrier drivers to use the services of European customs clearance agencies instead of issuing T1 declarations in Ukraine.

  1. Delays in cargo clearance due to

– Objective reasons: air raids, power outages (not all customs posts are equipped with uninterruptible power supply);

– Lack of relevant specialists in the territories under occupation;

– Increased number of inspections by customs authorities compared to the first months of the full-scale war.

Based on the results of the study, recommendations for improving the conditions of customs clearance were developed and addressed to the customs authorities, Ukrainian enterprises engaged in foreign economic activity and business associations.
