Results of the meeting with the representative of the World Customs Organization within the framework of the second stage of the WCO Technical Mission
Participants: members of the Association of Customs Brokers of Ukraine, a representative of the WCO, and a customs adviser of the Mission of Ukraine to the EU.
The following issues were discussed:
-the lack of a clear list of documents to confirm the customs value
-priority of the fiscal function in the work of customs
-inefficiency of domestic tax collection (VAT, income tax, personal income tax, etc.), which results in irresponsible attitude of the customs authorities to the confirmation of customs value
-absence of time limits for customs inspectors to accept the declaration for processing
-Possibility for customs inspectors to postpone the acceptance of a declaration for clearance
-the principle of selectivity in the processing of declarations by customs inspectors (the possibility of selecting the declaration for priority acceptance for processing by the inspector)
– customs clearance of goods in the “import” mode “according to tables” (i.e., representatives of customs authorities use available reference data in the form of tables and make decisions on the customs value of a particular imported product, which, according to business representatives, primarily serves to fill the budget)
-lack of a clear mechanism for confirming the corruption component in the actions of a particular customs inspector
-the process of processing and closing T1 declarations issued by Ukrainian customs brokers in the EU
-work of veterinary and phytosanitary services of the EU countries
-referral by European customs officers of carriers to local agencies for processing T1 declarations in Poland, Romania, Slovakia, Hungary
Proposals:
– granting discretionary powers to customs inspectors to display information about the actions of a particular inspector, which will remain in the system for investigation if necessary.
-Automatic acceptance of declarations into the database in order to prevent the principle of selectivity in the processing of declarations by customs inspectors
-Implementation of a system of control over customs clearance (government agencies working at the border, law enforcement agencies control the activities of customs officials and their quality of data processing)
-organizing a separate lane for trucks transiting to ports, in particular through the territory of Poland;
-when exporting goods through the EU countries: conducting veterinary and phytosanitary control directly at the destination customs offices in order to speed up the border crossing by trucks
